How long do I need to be separated before applying for divorce?
In Australia, parties generally need to be separated for at least 12 months before applying for divorce.
Is divorce the same as property settlement?
No. Divorce is the legal end of a marriage. Property settlement is a separate process dealing with assets, liabilities and financial matters.
Can you help with a sole or joint divorce application?

Is parenting time automatically 50/50?
No. Parenting arrangements are determined based on the best interests of the child and the practical circumstances of the family.
What is a parenting plan?
A parenting plan is a written agreement between parents about parenting arrangements. It is not legally enforceable in the same way as parenting orders.
What are parenting orders?
Parenting orders are legally binding orders made by the Court, either by consent or following a Court decision.
What is included in a property settlement?
Property settlement can include real estate, bank accounts, superannuation, businesses, vehicles, investments, personal property, liabilities and financial resources.
Is superannuation included?
Yes. Superannuation can be considered as part of the property settlement process.
Are there time limits for property settlement?
Yes. Married couples generally have 12 months after a divorce becomes final. De facto couples generally have 2 years from separation.
Do I have to attend mediation?
Many family law matters require parties to attempt resolution before court proceedings, depending on the circumstances. Legal advice can help you understand what applies to your matter.
Can a lawyer attend mediation with me?
Yes, depending on the mediation and support required.
What happens if we reach agreement?
Agreements may be formalised through consent orders or other legal documents.
Do all matters go to court?
